Vorsorgevollmacht & Patientenverfügung
Eine plötzliche oder altersbedingte Krankheit oder ein Unfall können nicht nur zu wesentlichen Veränderungen in der allgemeinen persönlichen Lebensgestaltung führen. Krankheit und Unfall können auch zur Folge haben, dass man seine persönlichen Dinge (rechtlich) nicht mehr selbst regeln kann und auf die Mitwirkung anderer angewiesen ist.
Der nächste Verwandte bzw. der Ehegatte oder der Lebensgefährte kann in solchen Situationen nicht automatisch für die betroffene Person handeln und entscheiden. Es ist daher ratsam, für solche Fälle Vorsorge zu treffen. So kann vor allem vermieden werden, dass andere fremde Personen allein über das eigene weitere Befinden entscheiden.
Wir Notare bereiten für diese Notfälle als Vorsorge auf den konkreten Einzelfall abgestimmte Vollmachten und andere Anordnungen vor. So wird die Gewähr geboten, dass die ausgesprochenen Vollmachten und weiteren Anordnungen im Notfall auch Geltung erlangen.
Im Wesentlichen stehen folgende Vollmachten und Anordnungen zur Verfügung:
- Generalvollmacht,
- Vorsorgevollmacht,
- Betreuungsverfügung und
- Patientenverfügung.
Die Vorsorgeurkunden werden im Zentralen Vorsorgeregister bei der Bundesnotarkammer in Berlin registriert, damit sie im Fall der Fälle auch gefunden und beachtet werden: Das Zentrale Vorsorgeregister wird inzwischen mehr als 20.000 Mal im Monat von Betreuungsgerichten aus ganz Deutschland abgefragt. Mehr als 1,1 Mio. Vorsorgeurkunden sind dort bereits registriert.
Mandat de protection future & directives anticipées
Une maladie soudaine ou liée à l’âge, ou un accident, peuvent entraîner non seulement des changements importants dans l’organisation générale de la vie personnelle. La maladie et l’accident peuvent aussi avoir pour conséquence que l’on ne puisse plus régler soi-même ses affaires personnelles (sur le plan juridique) et que l’on dépende du concours d’autrui.
Dans de telles situations, le parent le plus proche, le conjoint ou le compagnon/la compagne ne peut pas automatiquement agir et décider pour la personne concernée. Il est donc conseillé de prendre des dispositions pour de tels cas. On évite ainsi surtout que des tiers étrangers décident seuls de votre bien-être à venir.
Pour ces cas d’urgence, nous, notaires, préparons à titre préventif des procurations et autres dispositions adaptées au cas particulier concret. Cela garantit que les procurations délivrées et les autres dispositions prennent effectivement effet en cas d’urgence.
Sont essentiellement disponibles les procurations et dispositions suivantes :
- procuration générale,
- mandat de protection future,
- directive relative à la curatelle et
- directives anticipées (du patient).
Les actes de prévoyance sont enregistrés au Registre central des dispositions de prévoyance (Zentrales Vorsorgeregister) auprès de la Chambre fédérale des notaires (Bundesnotarkammer) à Berlin, afin qu’ils soient effectivement trouvés et pris en compte le cas échéant : le Registre central des dispositions de prévoyance est désormais consulté plus de 20 000 fois par mois par les tribunaux des tutelles de toute l’Allemagne. Plus de 1,1 million d’actes de prévoyance y sont déjà enregistrés.
Lasting power of attorney & living will
A sudden or age-related illness or an accident can lead not only to significant changes in your general personal way of life. Illness and accident can also mean that you are no longer able to manage your personal affairs (in legal terms) yourself and have to rely on the involvement of others.
In such situations, the closest relative, the spouse or the life partner cannot automatically act and decide on behalf of the person affected. It is therefore advisable to make provision for such cases. Above all, this avoids unfamiliar third parties deciding alone about your continued well-being.
For these emergencies, we notaries prepare, as a precaution, powers of attorney and other directives tailored to the specific individual case. This ensures that the powers of attorney granted and any further directives actually take effect in an emergency.
The following powers of attorney and directives are essentially available:
- general power of attorney,
- lasting (precautionary) power of attorney,
- care directive and
- living will (advance healthcare directive).
The precautionary documents are registered in the Central Register of Precautionary Documents (Zentrales Vorsorgeregister) of the German Federal Chamber of Notaries (Bundesnotarkammer) in Berlin, so that they are actually found and observed when the need arises: the Central Register of Precautionary Documents is now queried more than 20,000 times a month by guardianship courts throughout Germany. More than 1.1 million precautionary documents are already registered there.
